McEwen ORDINANCE NO. 9428 AN ORDINANCE TO AMEND ORDINANCE NO. 6958, AS AMENDED, KNOWN AS THE ZONING ORDINANCE, SO AS TO REZONE A TRACT OF LAND LOCATED AT 7454 EAST BRAINERD ROAD, BEING ON THE SOUTHWEST LINE OF EAST BRAINERD ROAD NORTHWEST OF SOUTH JOINER ROAD FROM R-1 RESIDENTIAL ZONE TO C-2 CONVENIENCE COMMERCIAL DISTRICT AND R-4 SPECIAL ZONE. _______________________ SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 6958, as amended, known as the Zoning Ordinance, be and the same is hereby amended so as to rezone: A tract of land located at 7454 East Brainerd Road, being on the southwest line of East Brainerd Road northwest of South Joiner Road. Two unplatted tracts, the first (to be zoned C-2) beginning on the southwest line of East Brainerd Road (as now located) some 90 feet northwest, then 15 feet southwest, of the intersection of the southwest line of the original East Brainerd Road with the northwest line of South Joiner Road (as now located), thence southwest some 300 feet to a point 300 feet southwest (if measured at a right angle) of the southwest line of the relocated East Brainerd Road, thence northwest some 313 feet parallel to, and at all points 300 feet southwest of, the southwest line of the relocated East Brainerd Road, thence northeast some 300 feet to the southwest line of the relocated East Brainerd Road, thence southeast some 273.5 feet with said East Brainerd Road to the point of beginning. To find the true point of beginning of the second unplatted tract (to be zoned R-4), start on the southwest line of East Brainerd Road (as now located) some 90 feet northwest, then 15 feet southwest, of the intersection of the southwest line of the original East Brainerd Road with the northwest line of South Joiner Road (as now located), thence southwest some 300 feet to a point 300 feet southwest (if measured at a right angle), of the southwest line of the relocated East Brainerd Road, the true point of beginning, thence continuing southwest some 86.83 feet, thence southeast 104.21 feet to the northwest line of South Joiner Road, thence southwest some 98.37 feet with South Joiner Road, thence northwest some 459.6 feet, thence northeast some 245.7 feet to a point 300 feet southwest (if measured at a right angle) of the southwest line of the relocated East Brainerd Road, thence southeast some 313 feet parallel to and at all points 300 feet southwest of, the southwest line of the relocated East Brainerd Road to the true point of beginning. from R-1 Residential Zone to C-2 Convenience Commercial District and R-4 Special Zone. SECTION 2. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage, the public welfare requiring it, as specified in the property descripions above.
